Kamaʻāina Date (808singles.com)

These Terms of Service ("Terms") are an agreement between you and RyPul Media ("Kamaʻāina Date," "we," "us"). They cover your use of 808singles.com and the Kamaʻāina Date web app (the "Service"). By creating an account or using the Service, you agree to these Terms, our Privacy Policy and our Community Guidelines.
1. Eligibility
You must be at least 18 years old. We ask for your date of birth at signup, and accounts of anyone under 18 will be removed.
The Service is for people in or connected to Hawaiʻi: locals, military personnel stationed here, people new to the islands and visitors.
You may not use the Service if you are barred by law from doing so, if we have previously removed you, or if you have been convicted of a violent or sexual offense.
You may have only one account, and it must represent you.
2. Your account
Give accurate information and keep your password secure. You are responsible for activity on your account.
Sign-in is provided through our authentication provider (Supabase). Tell us at kamadate@proton.me if you think your account has been compromised.
3. Community conduct
You agree not to:
- harass, threaten, stalk, intimidate or demean anyone, or use hate speech;
- impersonate anyone, use someone else's photos, or misrepresent your identity, age or intentions;
- ask other members for money, gift cards, crypto or financial information, or run scams;
- post nudity, sexually explicit content, violence, or photos of minors without a parent or guardian present;
- share another person's private information without their consent;
- advertise, solicit, spam, or use bots, scrapers or automated tools;
- use the Service for commercial or prostitution purposes, or for anything illegal;
- interfere with the security or operation of the Service.
The Service may not be used for human trafficking, including sex trafficking or any other form of sexual exploitation, or to aid, abet, or encourage abuse of any kind. This includes recruiting, advertising, soliciting or arranging commercial sex; exploiting or coercing any person; and any sexual content involving a minor. Violations result in immediate termination of all associated accounts and reporting to the appropriate authorities, including law enforcement and, for child sexual exploitation, the National Center for Missing & Exploited Children (NCMEC). Dating and relationships only: no sexually driven interactions
The Service is for dating and relationships only. You may not use it for sexually driven interactions, whether or not they are consensual. This includes soliciting, offering or arranging sex or hookups; offering or requesting sexual services, including escorting; sexting or exchanging sexual photos, videos or other sexual content; sugar arrangements or any other transactional companionship in exchange for money, gifts or benefits; and sexually explicit messages or profile content. Violations result in removal of the content and termination of your account. See Community Guidelines.
4. Safety
We do not conduct criminal background checks or identity screening of members. Optional photo verification only checks that a selfie matches profile photos. It does not verify identity, age, residency or character.
You are solely responsible for your interactions with other members, online and in person. Please follow our Safety Tips: meet in public, tell a friend, and never send money.
You can block, report or unmatch anyone. Reports are reviewed by our team, and we may take action at our discretion. If you are in danger, call 911.
5. Your content
You own the photos, text and messages you post ("Your Content").
You grant us a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce and adapt Your Content only to operate, improve and promote the Service. That includes resizing images and removing photo metadata such as location. The license ends when you delete the content or your account, except for copies we must keep for legal, safety or backup reasons for a limited time.
You confirm you have the rights to Your Content and that it follows these Terms.
We may review, moderate, hold for review or remove content that we believe breaks these Terms or the Community Guidelines.
6. Subscriptions, free trial and auto-renewal
Plans. Joining and browsing are free. Paid plans are Kamaʻāina Basic, $9.99 per month, and Kamaʻāina Plus, $19.99 per month, plus applicable taxes. Messaging between mutual matches is free on every plan. Photo verification is optional. Paid plans add unlimited daily Alohas. Kamaʻāina Plus also adds see who liked you, read receipts, one free 30-minute Profile Boost each month (no extra charge), incognito browsing, and advanced filters (kids, drinking, smoking, height). Plan features are described on the pricing page and may change with notice.
Women's free trial. Women who choose Kamaʻāina Basic get 1 month free. Unless you cancel before the trial ends, your subscription automatically converts to a paid Kamaʻāina Basic subscription at $9.99 per month, charged to the payment method you provided.
Auto-renewal. Paid subscriptions renew automatically each month at the then-current price until you cancel. By subscribing, you authorize us and our payment processor (Stripe for cards, or PayPal if you choose PayPal) to charge your payment method or PayPal account each billing period.
Cancellation. You can cancel anytime, online, as easily as you signed up. If you pay by card, use the "Manage subscription" button on your Profile page (our Stripe customer portal); cancellation takes effect at the end of the current billing period, and you keep paid features until then. If you pay with PayPal, tap "Cancel PayPal subscription" on your Profile page or cancel in your PayPal account under Automatic payments; no further charges are made, and you keep paid features until the end of the current billing period. You can also cancel by emailing kamadate@proton.me.
Refunds. Payments are non-refundable except where required by law.
Price changes. We will give you at least 30 days notice of any price change, and you can cancel before it takes effect.
Payments are processed by Stripe or PayPal. We do not store your full card number or your PayPal login.
Founding Member program
Who qualifies. The first 100 member accounts created on Kamaʻāina Date become Founding Members, in sign-up order, while spots remain. One account per person. We may remove founding status from duplicate, fake or rule-breaking accounts.
What you get. Kamaʻāina Plus features free for 3 months from the day your founding spot is granted, and a Founding Member badge on your profile. The badge stays as long as your account does.
No card, no automatic charge. No payment method is needed. When the free period ends your account goes back to the Free plan. It never converts to a paid subscription automatically. A paid plan only starts if you choose one and complete checkout yourself, and then the subscription terms above apply.
Referrals. Each person who creates a new account using your invite link, confirms their email address and has a profile photo approved adds 30 days of free Kamaʻāina Plus to your account, for up to 3 referrals (90 days). Referral time follows the same no-charge rule. Self-referrals and fake accounts don't count.
Changes. We may end or change the program for new sign-ups at any time. Free time already granted to you will be honored unless your account is removed for breaking these Terms.
7. Termination
You can delete your account at any time from your profile, or by emailing kamadate@proton.me.
Human trafficking, sexual exploitation, child sexual abuse material, or aiding, abetting or encouraging abuse leads to immediate termination and reporting to authorities.
We may suspend or terminate your account, with or without notice, if we believe you have broken these Terms, created risk for other members, or acted unlawfully. If we terminate you for a violation, you are not entitled to a refund of unused subscription time, except where required by law.
Sections 4, 5 (as to licenses already exercised), 8, 9, 10 and 11 survive termination.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT GUARANTEE MATCHES, THE CONDUCT OF ANY MEMBER, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR YOUR INTERACTIONS WITH OTHER MEMBERS. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US $100. Some jurisdictions do not allow these limits, so they may not apply to you.
10. Indemnity
You agree to indemnify and hold us harmless from claims arising from your conduct, Your Content, or your violation of these Terms or the law.
11. Governing law and disputes
These Terms are governed by the laws of the State of Hawaiʻi, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in the City and County of Honolulu, Hawaiʻi, and you consent to their jurisdiction.
12. Changes
We may update these Terms. If the changes are material, we will notify you by email or in the app before they take effect. Continuing to use the Service after that means you accept the updated Terms.
